Appeals

Atlanta, Georgia, Appellate Attorneys

When you are considering an appeal, it is important that you act quickly. Under the law, you have only a limited period of time to make a motion for a new trial or to appeal. Contacting a lawyer early helps make sure that you will meet this deadline. It also gives your lawyer time to develop the strongest, most complete arguments possible.

At the Atlanta law offices of Seth Kirschenbaum and Nicholas Lotito, we represent clients in state and federal criminal appeals. We start each appeal by diligently going through the transcripts of your trial. We look for legal issues — things that were not done or done wrong — that affected the outcome of your trial:

  • Ineffective assistance of counsel
  • A conflict of interest
  • Introduction of evidence that should have been excluded
  • Improper jury selection
  • Improper jury instructions
  • Failure to use DNA evidence or other exculpatory evidence
  • Discovery of new evidence
  • Recantation of testimony by a witness at the original trial

We then put together appellate briefs, legal documents designed to bring these issues to the attention of the court. When it is time, we present a strong and effective argument to either the state or federal appellate court, or if appropriate, the trial court.

State Court Appeals

When a state court trial goes wrong, when errors lead to a conviction, an appeal can be an effective way to make things right. We each have over 30 years of experience in matters of criminal law. We use this experience to help our clients achieve success in state court appeals.

Federal Appeals

Federal law is complex and the stakes are high. As former federal prosecutors, we have a highly-developed ability to pinpoint procedural errors at trial that can result in guilty verdicts. We use this ability to your benefit. Our in-depth examination of your federal trial transcripts helps us shape effective appeals.
